Detective services are services that are legally regulated by the Act on detective services.
In accordance with the statutory provisions:
Detective services are the activities of acquiring, processing and transmitting information on persons, objects and events, under a contract concluded with the customer:
- in cases arising from legal relations concerning individuals;
- in cases arising from the business relationship concerning:
a) carrying out property obligations, ability to pay or reliability of these relations,
b) unlawful use of trade names or trademarks, unfair competition or disclosure of the information constituting confidential business information of the compant;
3) verifying the reliability of information for claims submitted to the insurance company;
4) searching for missing persons or person being in hiding;
5) searching for property;
6) collecting information in a case in which there is a criminal proceeding, proceeding in cases of tax offenses or fiscal offenses or other, if in the course of the proceeding criminal law can be applied.
It is very important that the legislator provided in accordance with Article 8 of the Act on detective services following detective powers:
The detective is entitled to process personal data collected in the course of carrying out the activities referred to in Art. 2, paragraph 1, without a consent of persons whose data are processsed, regarding the case carried out by the entrepreneur having an entry in the register, only during conducting this case.

In connection with the amendment to the provisions of the Act on detective services (link: http://prawo.sejm.gov.pl/isap.nsf/download.xsp/WDU20170000556/O/D20170556.pdf) and the information obligation arising from the aforementioned Act and the GDPR (link https://www.giodo.gov.pl/pl/569/9276), hereby we inform that pursuant to art. 28c. of the Act on detective services for processing personal data collected in the course of performing the activities referred to in art. 2 clause 1, the provisions of art. 13 section 1 and 2 and art. 15 paragraph 1 lit. a, c and g of regulation of the European Parliament and of the Council (EU) 2016/679 dated 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (general regulation on data protection) (Official Journal of the EU L 119 of 04/05/2016, page 1, as amended) are not applied.
